DiLaura: An Open Letter to John Boehner

Dear Mr. Boehner,

I am a retired FBI Agent (1969-1995).

During my tenure as an agent, there was a serious problem that continues today, dealing with groups that claim to be religious faiths, using our First Amendment as a way to hide, deceive and disguise what they are doing.

Law enforcement’s hands are tied while violent groups use our Constitution to pursue violent goals, violate our rule of law and try to undermine and even overthrow our government and our way of life.

The Department of Justice passes rules and regulations restricting the FBI and other law enforcement organizations from doing their jobs in the name of “religious freedom under the First Amendment”, while the lawmakers sit idly by!

Congress has never passed any laws to address the problem and, as a result, we now have dozens of Muslim encampments spread across the US, training terrorists to kill you, me, our children and our grandchildren, all the while those who swore to protect, preserve and defend the Constitution do nothing but talk!

The "problem" is that “religion” in the first Amendment is undefined.

This allows anyone to claim religious protections provided by our Constitution and rule of law while violating those basic laws mandating the right of the people to “peaceful assembly”.

They gather together at places of “worship” and preach violence. They purchase property across the United States, build “encampments” protected by armed guards, barbed wire and cameras and practice terrorist military tactics and claim protection as a religion. Please name all the religions you can think of that both preach AND practice violence in the US, all of which is in violation of our rule of law!

We can both name one, and only one, can’t we?

It is the same one that killed 3,000 innocent Americans on 9-11-2001.

Our forefathers never intended that anyone claiming to be preaching a faith be allowed to rouse people to commit human sacrifice or otherwise kill, riot, assault all in the name of some radical ideology.

That’s why they said “peaceful assembly”!

There is a solution to this serious problem, but it takes a willingness for Congress to act to stop the propagation of terrorist in our country! We may not be willing or able to stop terror in Iraq or any other 3rd world country but we damn well better be able to stop it here or we will have no need for a legislative, or judicial branch of government, only an executive branch.

There is no law preventing Congress from defining religion as a “peaceful assembly” of people, as the first amendment clearly states.

May I suggest either a law, or Amendment to the Constitution, such as the following:

THE 28th AMENDMENT TO THE CONSTITUTION – RELIGION DEFINED

1. No group, of two or more people, that preaches or practices violence of any type, where that violence is in direct conflict with the Constitution or the Laws of the United States, or the Laws of the States, may be considered a Religion, as set forth in the First Amendment to the Constitution of The United States.

2. No such group shall be afforded any of the protections, either criminal or civil, afforded to Religions by the Constitution or the Laws of the United States or the Laws of the States and is by this Amendment defined as a Criminal Organization, and may be investigated and prosecuted to the fullest extent of the law by law enforcement agencies of the United States and the States in accordance with the laws of the United States and the states.

3. No investigation of any group, as defined in #1 above, by any duly appointed and sworn Law Enforcement Agency, may be thwarted, infringed or hindered by anyone or any Agency or any Judicial Jurisdiction under the claim of religion, religious group or faith.

4. Gunfire, explosions, military training, the practice of assault techniques by any group of two or more people who claim to be a religion, are all probable cause to believe that the group is not a religion.

All this really intends to declare is that, under our rule of law, a religion MUST be peaceful and abide by our laws! Congress should establish the penalty for violating this law.
